Actor Alec Baldwin filed a lawsuit Friday in California against several people associated with the movie “Rust,” according to a cross-complaint obtained by CNN.
Cinematographer Halyna Hutchins was fatally shot by the actor last October during a rehearsal for a scene for the film, which was being filmed near Santa Fe, New Mexico.
The lawsuit is the first legal case in which Baldwin claims he committed a crime against someone related to the shooting.
Baldwin, who is listed as a defendant in a 2021 lawsuit by “Rust” script supervisor, filed the cross-complaint against production arm Hannah Gutierrez Reed, assistant director David Halls, a -army assistant Seth Kenney, ammunition and ammunition supply store. by the Kenney company, and prop master Sarah Zachry.
“More than anyone else on that set, Baldwin has been wrongly viewed as the perpetrator of this tragedy. “With these Cross-Examinations, Baldwin seeks to clear his name and hold Defendants accountable for their misconduct,” the cross-complaint states.
“This accident occurred because live bullets were delivered to the set and loaded into the gun, Gutierrez Reed did not carefully inspect the bullets or the gun, Halls did not carefully inspect the gun and however, they declared the gun safe before giving it to Baldwin, and Zachry did not fail to point out that Gutierrez Reed had been acting recklessly on set and that he posed a safety risk to those around her,” the complaint alleges, adding that Baldwin was not aware of these facts, but the defendants were.
“These Guardians of the Cross are professionals whose responsibility it was to those on set, including Baldwin, to keep the set safe. Everyone on set, including Baldwin, expected and trusted that they would. Hutchins would never have instructed Baldwin to put the gun to her side and pull back the hammer if she thought there was even the slightest possibility that it was loaded; Baldwin, who was of the same mind as Hutchins in that critical moment, would not have done so under those conditions,” the lawsuit states.
Baldwin is seeking “compensatory, nominal, statutory and punitive damages” through a jury trial, costs associated with litigation, and other relief to be determined by the Los Angeles County Superior Court, the cross-complaint says .
In an August 2022 interview with CNN, Baldwin blamed the film set tragedy on Gutierrez Reed and Halls, who gave him the gun.
Jason Bowles, Gutierrez Reed’s lawyer, told CNN on Friday: “He was the one who killed Halyna, and it’s his fault, no one else’s.”
When asked in August for comment, Halls’ attorney accused Baldwin of shifting the blame to others.
Kenney’s lawyers have previously denied responsibility in the shooting.
